Terms and Conditions of Sale

Last updated: 7 October 2026

1. Seller and contact

The artworks and items presented on www.gracepegeron.com (the "Site") are signed Grâce Pégéron, painter. Full identity: see the Legal Notice.

Contact: contact@gracepegeron.com or the Contact page.

2. Purpose

These terms and conditions of sale ("T&Cs") govern the online sale of original artworks (paintings on canvas) and derivative products (mugs, cushions, postcards, etc.) on the Site. They apply to any order placed by a consumer buyer.

3. Products

The products conform to the descriptions and photographs presented on the Site. Original artworks are unique, hand-painted pieces. The dimensions given are those of the artwork, with a tolerance of [± 1 cm].

Screens do not reproduce colours accurately. Slight variations in shade, inherent to photographic reproduction and screens, may exist between the image and the product.

Derivative products (mugs, cushions, postcards, etc.) are manufactured by third-party printing providers. The reproduced image is the one presented on the Site. The item itself (model, shape, finish, exact shade, dimensions) may differ slightly from the one illustrated, as these providers may change their models. The essential characteristics stated on the product page (type of product, material, approximate dimensions) are respected. This clause does not limit the buyer's rights under the legal guarantee (article 9).

4. Orders

The order is confirmed once payment has been received. A confirmation email is then sent to the buyer.

As an original artwork is a unique piece, if it proves to be unavailable despite the order having been confirmed, the buyer will be informed without delay and fully refunded.

5. Prices

Prices are stated in euros, all taxes included. Delivery costs, where applicable, are shown before the order is confirmed. Where delivery is free or included in the price, the product page says so. The applicable price is the one in force at the time of the order. The seller may change prices at any time, without effect on orders already confirmed.

6. Payment

Payment is due at the time of the order, by PayPal or Stripe. Payment data is processed securely by these providers, and the seller has no access to it. Without payment, the order is not confirmed.

7. Delivery

Unless otherwise stated on the product page, products are delivered within a maximum of [30] days from the date of the order. In the event of delay, the buyer may formally require the seller to deliver within an additional reasonable period. If delivery has not taken place by the end of that period, the buyer may terminate the contract in writing and be refunded within 14 days. The buyer may terminate the contract immediately where the delivery date was an essential condition of the order.

8. Right of withdrawal

The buyer has 14 days from receipt of the product to withdraw from the contract, without giving a reason and without penalty (art. L. 221-18 of the French Consumer Code).

How to exercise it: by email to contact@gracepegeron.com, or via the Contact page, with an unequivocal statement (for example: "I hereby notify you of my withdrawal from order no. … placed on …").

Return: the buyer returns the product no later than 14 days after notification, at their own expense, in protective packaging and in its original condition.

Refund: within 14 days of notification, using the same means of payment. The seller may defer the refund until the product has been received or proof of its dispatch has been provided. The buyer is liable for any loss in value resulting from handling other than what is necessary to establish the nature and condition of the product.

Exclusion: the right of withdrawal does not apply to products made to the buyer's specifications or clearly personalised (art. L. 221-28 3° of the French Consumer Code), in particular commissioned artworks.

9. Legal guarantee of conformity

The seller is liable for any lack of conformity existing at the time of delivery and appearing within 2 years of delivery (art. L. 217-3 et seq. of the French Consumer Code). The buyer may choose between repair and replacement, unless the cost is manifestly disproportionate. Failing that, the buyer may obtain a price reduction or termination of the sale. The buyer does not have to prove that the defect existed during the 24 months following delivery. The buyer also benefits from the guarantee against hidden defects (art. 1641 et seq. of the French Civil Code). To invoke it, the buyer writes to contact@gracepegeron.com or via the Contact page.

10. Intellectual property

The purchase of an original artwork or a derivative product gives the buyer ownership of the physical item only. All copyrights (reproduction, performance, adaptation, etc.) remain the exclusive property of the artist. No transfer of rights is granted by the sale.

11. Liability

The seller undertakes to deliver products that conform to their description and are of good quality. The seller's liability cannot be engaged in the event of force majeure or disruption (a strike, for example) affecting delivery, within the limits permitted by law.

12. Personal data

The data controller is Grâce Pégéron, contact@gracepegeron.com. The data collected (identity, address, email, order details) is used to process and deliver orders, manage invoicing and respond to enquiries. Legal basis: performance of the contract and legal obligations.

It is shared only with the providers needed to fulfil the order: website hosting, online payment, printing of derivative products and shipping. Some of these providers may be located outside the European Union; appropriate safeguards then govern the transfers of data.

Retention period: [3 years] after the last order for the commercial relationship, [10 years] for accounting records.

The buyer has the rights of access, rectification, erasure, objection, restriction and portability, to be exercised by email to contact@gracepegeron.com. In the event of disagreement, the buyer may lodge a complaint with the CNIL (cnil.fr), the French data protection authority.

13. Disputes

These General Terms and Conditions of Sale are governed by French law. In the event of a dispute, the consumer must first send a written complaint to the seller, and an amicable solution will be sought as a priority. Failing that, the consumer may bring the matter before the competent court in accordance with the applicable legal rules.

14. Acceptance

Any order placed on the Site implies full acceptance of these T&Cs, which the buyer can read on the Site before ordering.

In case of discrepancy, the French version prevails.
